AthenaIQ Technologies LLC Effective date: September 29, 2026
This Privacy Policy explains how AthenaIQ Technologies LLC ("AthenaIQ," "we," "us," or "our") collects, uses, and shares information when you visit athenaiqtech.com, contact us, or use our software, including Trucking OS (together, the "Services").
1. Information we collect
Information you give us
- Contact and business details, such as your name, email address, phone number, company name, fleet size, and preferred language, when you fill out a form, request a demo, call, text, email, or message us.
- Account information, such as login details and your role, when you or your organization create an account.
- Billing information, such as your billing name and address. Payment card details are collected and processed by our payment processor (Stripe); we do not store full card numbers.
- Communications with us, including emails, chat and social media messages, text messages, and phone calls. Calls may be recorded and transcribed, and we tell you this at the start of the call.
- Your communication preferences, including whether you agreed to receive calls and text messages, and the date, time, and wording of that agreement.
Information our customers put into the Services ("Customer Data") Trucking companies that use our Services may upload or enter information such as driver details, load and shipment records, documents (for example, proof of delivery or compliance documents), vehicle and maintenance records, and invoices. We process Customer Data on behalf of our customers and according to their instructions and our agreement with them. If you are a driver or other person whose information was entered by a trucking company, please contact that company with questions about your information.
Information collected automatically When you visit our website or use the Services, we and our service providers collect information such as IP address, browser and device type, pages viewed, referring website, the campaign or link that brought you to us, and dates and times of visits. We use cookies and similar technologies for this purpose (see Section 5).
2. How we use information
We use information to:
- Provide, operate, maintain, and support the Services;
- Respond to inquiries, schedule demos, and follow up on requests;
- Set up accounts, onboard customers, and process payments and subscriptions;
- Send service messages, such as account notices, billing notices, and security alerts;
- Send marketing communications where permitted, including calls and text messages only if you have agreed to receive them;
- Understand how people find and use our website and Services, and measure which marketing is effective;
- Improve and develop our products and features;
- Detect, prevent, and respond to fraud, abuse, and security incidents; and
- Comply with legal obligations and enforce our agreements.
3. Artificial intelligence
Where enabled, we use artificial intelligence tools to help answer calls, texts, emails, and chat messages, summarize conversations, draft responses, and support features of the Services. When you communicate with an AI assistant, we will tell you. You can ask to speak with a person at any time. Information you share in these conversations may be processed by our AI service providers under agreements that restrict their use of that information. We do not allow our AI service providers to use Customer Data to train their general models, where their terms give us that choice.
4. How we share information
We do not sell your personal information.
We share information only as follows:
- Service providers that help us run our business and the Services, such as hosting and infrastructure, customer relationship management, payment processing, phone and messaging, email, analytics, authentication, workflow automation, and AI services. They may use information only to provide services to us.
- Within your organization, for example, account administrators can see information about users in their organization's account.
- Legal and safety reasons, when we believe disclosure is required by law, legal process, or to protect the rights, property, or safety of AthenaIQ, our customers, or others.
- Business transfers, in connection with a merger, acquisition, financing, or sale of assets, subject to this Privacy Policy.
- With your consent or at your direction.
Mobile information and text messaging. Mobile phone numbers and text messaging consent collected through our Services will not be shared with or sold to third parties or affiliates for their marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except service providers that help us deliver our messaging program.
5. Cookies and analytics
We use cookies and similar technologies to operate our website, remember preferences, understand traffic and marketing performance, and improve the Services. Our website uses the following tools:
- HubSpot: manages inquiry forms and customer relationship records and, when you allow analytics, connects website visits and campaign sources to inquiries.
- Google Analytics: measures website traffic and conversion activity when you allow analytics.
- Microsoft Clarity: helps us understand page interactions through analytics and session recordings when you allow analytics.
Optional analytics remain off until you allow them through our cookie banner. You can change your choice using the Analytics choices control in the website footer. We also honor Global Privacy Control for these optional analytics. Declining analytics does not prevent you from contacting us or submitting an inquiry form. HubSpot processes information you submit through the form so we can respond, whether or not you allow optional analytics.
You can also control cookies through your browser settings. Blocking some cookies or scripts may affect how the website works. Attribution may be limited when you decline analytics or use browser privacy controls.
6. Calls and text messages
If you agree to receive calls and text messages from AthenaIQ, including automated or AI-generated calls, we will contact you about your account and offers. Consent is not required to purchase anything. Message frequency varies. Message and data rates may apply. Reply STOP to opt out of text messages at any time, or HELP for help. You can also opt out of calls by telling us during a call or emailing info@athenaiqtech.com. We will honor opt-out requests promptly.
7. Data retention
We apply the following retention periods:
- Call recordings and transcripts: 1 year from the date of the call.
- Texts, emails, and chat logs with AthenaIQ: 2 years from the date of the communication.
- Consent and opt-out records: 5 years from the date of the consent or opt-out record. Expiration of a record does not create or restore permission to contact you.
- Customer Data held on behalf of subscribing businesses: during the subscription and for 30 days after cancellation takes effect at the end of the current billing period, to allow export; we then delete it.
The 30-day Customer Data export window is separate from the communication, consent, and opt-out retention periods above. Where applicable law requires us to retain particular records longer, we retain only the records required for that purpose. We handle legally required billing and transaction records separately from Customer Data held for export.
8. Security
We use reasonable administrative, technical, and physical safeguards to protect information, including access controls, encryption in transit, and separation of each customer's data. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
9. Your choices and rights
- Marketing emails: use the unsubscribe link in any marketing email.
- Text messages: reply STOP.
- Calls: ask us to stop calling you.
- Access, correction, and deletion: depending on where you live, including under the Texas Data Privacy and Security Act and other state privacy laws, you may have the right to request access to, correction of, deletion of, or a copy of your personal information, and to opt out of certain processing. To make a request, email info@athenaiqtech.com. We may need to verify your identity before responding. You may appeal a decision by replying to our response. We will not discriminate against you for exercising your rights.
If your information is part of Customer Data, we may refer your request to the trucking company that controls it.
10. Children
Our Services are intended for businesses and are not directed to children under 13 (or under 16 where applicable). We do not knowingly collect personal information from children.
11. Changes to this policy
We may update this Privacy Policy from time to time. If we make material changes, we will update the effective date and, where appropriate, notify you by email or through the Services.
